After section 52 of the original Act, the following section 52A. Added:- “52a. Arrangements for understanding expert witnesses :- (1) Notwithstanding anything else written in this Act, if an expert witness is unable to appear for the deposition on the day specified for the deposition and receives written information of the same, the court may order such expert to appear for the deposition at an appropriate time.
(2) Notwithstanding anything contained in sub-section (1), in case of the death of the expert who expressed the expert opinion in any case related to a heinous or serious criminal offense involving the Government of Nepal or for any other reason. >If it is not possible to understand him and if the expert cannot be understood, then the expert opinion can be understood from another expert on the same subject."
